1. Parties and Scope

These Terms of Service (hereinafter "Terms") constitute a legally binding agreement between Escuela de Wok (hereinafter "the School," "we," or "us"), a culinary education business operating in Madrid, Spain, and any individual who accesses our website, registers for courses, or otherwise engages with our services (hereinafter "User," "you," or "your").

By accessing our website at www.escueladewok.com or registering for any course, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.

2. Description of Services

Escuela de Wok provides in-person culinary courses focused on Chinese cuisine, including but not limited to:

Hands-on cooking workshops (beginner, intermediate, and advanced levels)
Dim Sum, Sichuan, Cantonese, and other regional Chinese cuisine classes
Private group classes and corporate events
Culinary certification programs

All classes are conducted at our premises located in central Madrid. We reserve the right to modify, suspend, or discontinue any course offering at any time, with reasonable advance notice where possible.

3. Enrollment and Registration

To register for a course, Users must complete the online reservation form and provide accurate personal information, including full name, email address, phone number, and any relevant dietary restrictions or allergies. The registration is confirmed only upon receipt of full payment or written confirmation from Escuela de Wok.

Users must be at least 16 years of age to enroll independently. Minors between 14 and 16 years of age may participate only with written consent from a parent or legal guardian, who assumes full responsibility for the minor's participation.

By registering, you warrant that all information provided is accurate and complete. Escuela de Wok shall not be liable for any consequences arising from inaccurate or incomplete information provided at registration.

4. Pricing, Payment, and Taxes

All prices listed on our website are expressed in Euros (EUR) and include applicable Value Added Tax (VAT/IVA) at the current Spanish statutory rate, unless otherwise stated. Prices are subject to change without prior notice, but no price changes shall apply to confirmed bookings already paid.

Payment is required at the time of reservation to secure your place. We accept major credit and debit cards, bank transfer, and such other payment methods as indicated on our website at the time of booking.

Escuela de Wok issues a fiscal invoice (factura) for all transactions upon request. VAT registration number and other fiscal details will be included in all invoices as required by Spanish law (Ley 37/1992, del Impuesto sobre el Valor Añadido).

5. Cancellation and Refund Policy

We understand that circumstances change. The following cancellation policy applies to all reservations:

Cancellation more than 48 hours before the class start time: full refund of the amount paid.
Cancellation between 24 and 48 hours before the class start time: 50% refund.
Cancellation less than 24 hours before the class start time: no refund. However, the reservation may be transferred to a future class of equal value, subject to availability, within 90 days.
No-shows without prior notice: no refund.

All refund requests must be submitted in writing to info@escueladewok.com. Refunds will be processed within 14 business days using the original payment method.

Escuela de Wok reserves the right to cancel or reschedule a class due to insufficient enrollment, instructor unavailability, force majeure events, or other circumstances beyond our reasonable control. In such cases, Users will be offered a full refund or a transfer to an alternative session.

6. Conduct, Health, and Safety

All participants are expected to conduct themselves respectfully toward instructors, staff, and fellow participants. Escuela de Wok reserves the right to remove, without refund, any participant whose behavior is deemed disruptive, dangerous, or disrespectful.

Users must disclose all known food allergies, intolerances, and relevant medical conditions at the time of registration. While we make reasonable efforts to accommodate dietary requirements, we cannot guarantee a completely allergen-free environment. Users assume full responsibility for managing their own health conditions during class participation.

Participants must follow all health and safety instructions provided by instructors at all times. The use of kitchen equipment is at the participant's own risk. Appropriate footwear is required in all kitchen areas.

7. Intellectual Property

All content on the Escuela de Wok website, including but not limited to recipes, course materials, photographs, videos, logos, and written content, is the exclusive property of Escuela de Wok and is protected by Spanish and European Union intellectual property laws.

Users may not reproduce, distribute, modify, publicly display, or commercially exploit any content from our website or course materials without our prior written consent. Printed recipe booklets provided during classes are for personal, non-commercial use only.

8. Privacy and Data Protection

Escuela de Wok processes personal data in compliance with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) and Ley Orgánica 3/2018 (LOPDGDD). Personal data collected through our website and registration process is used exclusively for the purpose of managing enrollments, communicating with participants, and complying with legal obligations.

We do not sell, rent, or share your personal data with third parties except as required to process payments or comply with applicable law. You have the right to access, rectify, erase, restrict processing of, and port your personal data. Requests may be submitted to info@escueladewok.com.

9. Limitation of Liability

To the fullest extent permitted by applicable Spanish law, Escuela de Wok shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to personal injury during class, loss of property, or dissatisfaction with course content.

Our total aggregate liability to any User shall not exceed the amount paid by that User for the specific course giving rise to the claim. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Spain. Any disputes arising from or relating to these Terms or the services provided by Escuela de Wok shall be submitted to the exclusive jurisdiction of the courts of Madrid, Spain.

Before initiating formal legal proceedings, both parties agree to attempt in good faith to resolve any dispute through direct negotiation. If not resolved within 30 days, either party may pursue available legal remedies.

11. Modifications to These Terms

Escuela de Wok reserves the right to update or modify these Terms at any time. The revised Terms will be posted on our website with an updated effective date. Continued use of our services after such modifications constitutes acceptance of the revised Terms.
